1- Explicit consent.

By signing up on our website and uploading your content including your music, you give explicit consent for us to use your content solely for the purposes set out on this website. That is, for the purposes of the promotion of your music, events and the promotion of yourself as an artist as a whole. You consent to us displaying your content on our platform across all devices – desktop and mobile, across our network of partner sites and affiliates and across all our social media platforms. By signing up to the platform you agree to us sending you occasional marketing emails, providing you with the latest offers, updates and announcements. You can opt out from these emails at any time you wish, simply by unsubscribing using the unsubscribe link contained in the email. 

All songs uploaded onto the TuneSick platform should be copyrightedand registered with PRS, Sentric, ASCAP or any other relevant authority. It is your responsibility to ensure all songs uploaded comply with all copyright and licenscing and DMCA laws. If found to not be in accordance as such, we shall move swiftly to take down any unathorised content and disable your TuneSick account.

If you upload songs onto TuneSick through one of our approved distributors, they will be responsible for collecting any money owed to you and ensuring you get your payments. We will use the data collected by them to compile your artist profile and help verify your account. Your point of contact will be the distributor and the oringinal account manager who would of reached out to you and who you spoke to at the beginning of the account creation process.

We do not, in any shape or form, have any ownership or intellectual rights to the music you share through our platform. Our platform exists solely to act as a 'host' for your music, a channel whereby listeners can have unlimited access. If there is to be found any content that is being used on the site without the owners' permission we will take it down swiftly. Users assume full responsibility and liability for all content uploaded on the platform. Our DMCA and complaints procedure exists to protect the legal rights of copyright owners and we strive to maintain our integrity as an ethical streaming and sharing platform.

You grant TS, royalty free worldwide license to use any photos, audio and moving content in relation to which you have responded in registering on our platform, hereinafter referred to as “Photos, Audio and Moving Content” for its marketing and/or in its advertising, including the online store, newsletters, email, social media – TS channels and paid social media, store materials and other customer communications. TS may use, reproduce, distribute, combine with other materials, alter and/or edit your Photos and Moving Content in its sole discretion.
You hereby represent and warrant that (i) you own all rights in and to your Photos and Audio, (ii) you have permission from any person(s) appearing in your Photos to grant the rights herein, and (iii) TS's use of your Photos will not violate the rights of any third party or any law. You hereby release and discharge TS from all and any obligation to pay you for any use of your Photos and any of the intellectual property rights contained therein in connection with the uses described above; and You hereby release, discharge and agree to hold TS and any person acting on TS's behalf harmless from all claims, demands, and liabilities whatsoever in connection with use of the Photos and Audio as described above.
If, for any reason you wish to cancel your account, you can do so with immediate effect, however, it can take up to 6 months for all music and musical related content to be completely removed from the site and associated channels. In some cases it may be that traces of your historical content may still appear and so we cannot always guarantee complete removal, however, we will always act upon and do our upmost in any such request to remove any unwanted content.

If I upload songs to TuneSick, do I still retain all the rights to them? Absolutely. TuneSick not a record label, publisher, agent or distribution company.It is a wholly independent streaming and sharing platform that allows users to sell and share their music online. There is no contract in place that restricts the distribution or promotion of your music and we do not have any ownership rights whatsoever. This platform merely acts as a host for your music, a gateway between you as an artist and listeners.
We do not charge any fees for using this service. Payments for streams are made directly to you or somebody you specify. A 20% commission is on downloads is taken as part of our service.
Your data is stored and protected with rigorous standards to prevent or minimize any possible data breach. As part of our commitment to to privacy and data protection, TuneSick will not share your personal data with other organisations without your consent. We do not install tracking software on your device and will not send unsolicited mail to any user. We use appropriate technical and organisational measures to protect your personal data against unauthorized or unlawful processing and against accidental loss, destruction or damage. Our servers and websites are cloned and backed up on a daily basis; we also use servers across multiple providers to ensure minimal chance of data loss, hacking or breaching.

End User License Agreement

TuneSick is a platform to stream and share music and other audio content. By accessing or using our Services, you agree to be bound by our Terms. If you do not agree to these Terms, you may not access or use our Services. Below is our End User License Agreement (EULA) or 'Term's as it is otherwise known.

Use of our services

TuneSick grants you a personal, non-transferable, non-exclusive, revocable, limited license to use and access our services solely as permitted by these terms. We reserve all rights not expressly granted to you by these Terms.

Except otherwise permitted by us in writing, your license does not include the right to: license, sell, transfer, assign, distribute, host, or otherwise commercially exploit the services or content; modify, prepare derivative works of, disassemble, deconstruct, or reverse engineer any part of the services or content; or access the services or content in order to build a similar or competitive website, product, or service.
We reserve the right to modify, suspend, or discontinue our services at any time, with or without notice to you. Any future release, update, or other addition to functionality of the services will be subject to these terms, which may be updated from time to time. You agree that we will not be liable to you or to any third party for any modification, suspension, or service discontinuation.

Third Party Advertising 

Our services may contain links to third-party websites, products, or services, which may be posted by advertisers, our affiliates, our partners, or other users (“Third-Party Content”). Third-party content is not under our control, and we are not responsible for any third party’s websites, products, or services.

Your TuneSick Account, Safety & Security

You are solely responsible for the information and content posted in your account and anything that happens related to it. You are not permitted to upload or share any content that you do not own, or have legal right or consent to do so. Any content should be used in accordance with copyright law in the USA and UK and the country you are in. If you believe the see any content or information that is not in line with our terms you should report it to us immediately or issue a take down request (DMCA). 

We take no responsibility for or endorse, support, or guarantee the completeness, truthfulness, accuracy, or reliability of any of the content posted on our site - unless otherwise expressly stated by our official TuneSick account.

When your content is submitted or added to our platform, you grant us a global, perpetual, irrevocable, royalty free, non-exclusive, transferable, and sublicensable license to use, copy, modify or adapt, prepare derivative works of, distribute, perform, display and store the content and any name, username, voice, or likeness provided in connection with the content in all our media outlets and channels now known or later developed. This license includes the right for us to make your works available for broadcast, distribution, syndication or publication by other companies, organizations, or individuals who we may partner or be affiliated with.

We will never assume any ownership or financial rights to any of your content nor do we ever seek to. All work you post will always belong to you and such ownership shall never be ceased upon submission of said works to our platform. 

You can delete your account at anytime. You can also download the data held within your account at anytime. Once your account is deleted, we will no longer have access to any content that was hosted on the platform. However, there may still be content associated with the account being shared on any of our other media formats or channels. 

Although we have no obligation to screen, edit, or monitor your content, we may delete or remove it at any time if it is found to be violating any of our terms. Again, although there is no obligation for us to give you notice prior to deleting any content, we shall generally do so by email, and may give you up to 24 hours to respond - if the circumstances allow. 

If a user posts any hate speech, or any comment that is likely to cause harm to another, it can be reported and taken down immediately (within 24 hours). The offender will receive one warning, depending on the severity of the comment. If the offender makes another post causing harm after receiving their first warning, then he or she will be removed without notice. We make it easy for you to flag and report any comment or speech that violates these terms. Next to any piece of audio there is a link which you can select to submit any report or take down request. Under your settings tab, you can also block another user whom you would not like to communicate with or be visible to. We respond to any reports of hate immediately. DMCA complaints will be looked at thoroughly and the infringing work taken down if it is found to be in breach of copyright.

You must maintain the security of your account and immediately notify us if you discover or suspect that your account security has been compromised or someone has accessed your account without your permission. We strongly recommend that you use a strong password and enable unusual browser login prompts and two-factor authentication.

Governing Law & Jurisdiction

Unless otherwise stated by TuneSick, any claim or dispute borne out of these terms shall be dealt with and governed by the laws of the United Kingdom, England & Wales.By using our service you agree to the jurisdiction of these courts.

Changes To Terms

We may, from time to time make changes or updates to these terms; in such instances you will be notified at least 7 days prior to the implementation of such changes either by email or by a notice being displayed on the site for up to 7 days before and after the effective implementation date of such changes. By continuing to access our services after the date of any changes you automatically consent to abide by them and accept provision of our services under the new terms. 

Termination

You may exit this agreement at any time simply by deleting your account. Your account may also be deleted after prolonged period of inactivity. In such instances, you may be notified by email, although this is solely at our discretion.

Our failure to exercise or enforce any right or provision of these Terms will not operate as a waiver of such right or provision. If any provision of these Terms is, for any reason, held to be illegal, invalid, or unenforceable, the rest of the Terms will remain in effect.
